Pet Pantry Agreement
1. Purpose of the Service
The HBSPCA Pet Food Pantry Service ("Service") is intended exclusively for households experiencing short-term financial hardship and is not designed to provide a permanent or long-term solution for pet food needs. By accessing or using the Service, you agree to use this Service in good faith, and solely to address temporary financial challenges related to feeding your pets. Reselling product can result in termination of the program.
2. Agreement to Terms and Conditions
These Terms and Conditions establish a legally binding agreement between You ("User") and HBSPCA ("Company"), defining Your rights and obligations regarding Your use of the Service. By accessing or using the Service, You acknowledge and accept these Terms and Conditions and agree to comply with them fully. If You disagree with any portion of these Terms and Conditions, You are not authorized to access or use the Service. For clarity, using this Service means you agree to comply with all terms and conditions included herein.
These Terms and Conditions apply to all visitors, users and others who access or use the Service.
3. Privacy Policy Compliance
Your use of the Service is also governed by the Company's Privacy Policy. This policy explains how Your personal information is collected, used, and disclosed when You use this Service and informs You about Your rights under applicable privacy laws. By accessing or using the Service, You consent to the practices outlined in the Privacy Policy, and we strongly encourage You to read it carefully before using the Service.
4. Ordering Guidelines
Repeat Orders
Due to the high-demand of our Emergency Pet Pantry Program, You agree not submit additional or repeat orders, as this will reset Your order in the queue (your initial order will be removed).
For clarity, if You submit a new order request before Your previous order is completed, the earlier order will be canceled, and the new order will be fulfilled. This process places Your new order at the end of the queue.
Household Limit
You are only permitted to order for the pets in Your household. Orders placed for other households or individuals are strictly prohibited.
Monthly Supply Limit
You must only order an amount sufficient for one month per pet. If greater quantities are available, the HBSPCA will arrange to deliver accordingly, in it's sole discretion.
Availability
All pet food and supplies are donation-based and subject to availability. Your order quantities, types and supplies are not guaranteed as a result of placing an order.
HBSPCA makes no guarantees regarding available quantity, brand, type, or suitability for specific dietary needs, allergies, or other requirements.
Maximum Pets
The City of Hamilton Animal By-Law and City of Burlington By-Laws only permit a maximum of 4 animals (of all species) per household.
In compliance with our Municipal By-Laws which govern HBSPCA and citizen activities, HBSPCA cannot provide food for more than 4 animals per household.
Any order You place which appears to request food quantities in excess of a monthly supply for 4 animals will not be delivered and may be reported to the respective municipality, as required in respective By-Law's.
5. “AS IS” and “AS AVAILABLE”
The Service is provided to You on an “AS IS” and “AS AVAILABLE” basis, with no warranties or guarantees of any kind.
The Company provides no guarantee that it can or will provide the requested brand, type, flavour, or quantity of pet food, nor that it can or will provide the same (consistent) food items from one order to another, that You may place. Further, the Company cannot provide a guarantee for timeline of delivery or pickup of items related to the Service.
You acknowledge that changing the type, brand, flavour, or ingredients of Your pet's food may have adverse health affects, and agree to indemnify The Company of any such adverse health affects which may arise. You understand that this Service is designed to be used for a short period of time (i.e. up to one month).
You agree that it is your responsibility to inspect any supplies provided to You through this Service for quality, non-contamination, recalls, potential hazards, or any concerns otherwise, and agree to indemnify The Company of any potential defects in distributed product from the Service, or any actions from usage of the Service.
For clarity, by using the Service, You agree that you will not hold the Company liable for any adverse pet health impacts, effects or conditions resulting or in-relation to the supplies provided under this Service.
6. Non-Warranty
To the maximum extent permitted by law, the Company disclaims all warranties, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, title, non-infringement, or compatibility. The Company does not guarantee that the Service will meet Your requirements, be uninterrupted, error-free, or that any defects will be corrected.
Neither the Company nor its service providers make any warranties regarding:
- The operation or availability of the Service.
- The accuracy, reliability, or currency of any content, information, materials, or products offered.
- The Service’s compatibility with other software or services or the presence of errors or interruptions.
Some jurisdictions do not permit the exclusion of certain warranties or limitations, and in such cases, the above exclusions will apply to the fullest extent allowed by law.
7. Dispute Resolution
In the event of any dispute or concern regarding the Service, You agree to initially attempt to resolve the matter informally by contacting the Company. Should informal resolution prove unsatisfactory, further actions will be subject to applicable legal and procedural measures under Canadian law.
By using this Service, You acknowledge that You have read, understood, and agree to these Terms and Conditions. If You do not agree, do not access or use the Service.
